Terms of Service
1. Acceptance of Terms
By accessing or using Hour by OpsPilot (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including business owners, managers, and employees.
2. Description of Service
Hour by OpsPilot is a cloud-based employee time clock and scheduling platform operated by OpsPilot LLC. The Service enables businesses to manage employee schedules, clock-in/out records, shift swaps, time-off requests, payroll exports, and related workforce operations.
3. Accounts and Access
Business owners create an account via the setup flow and are responsible for their organization's use of the Service. Managers and employees access the Service using credentials granted by the business owner. You are responsible for keeping login credentials and PIN codes confidential. Unauthorized access is prohibited.
4. Acceptable Use
You agree not to: clock in/out on behalf of another employee; falsify time or payroll records; access features beyond your authorized role; reverse-engineer or copy any part of the Service; or use the Service in any way that violates applicable law.
5. Multi-Tenant Data
Hour operates as a multi-tenant platform. Each business account is logically isolated. OpsPilot LLC will not access, share, or transfer your data to any other customer or third party, except as required by law or described in the Privacy Policy.
6. SMS Notifications
By opting in to SMS notifications, users consent to receive work-related text messages including schedule updates, shift reminders, and clock-out alerts. Message and data rates may apply. Users may opt out at any time by replying STOP or updating their preference in the app. Reply HELP for assistance.
7. Location Data
If geofencing is enabled, the Service may request GPS location at clock-in to verify proximity to the work area. Location is not tracked continuously and is not retained beyond the clock-in event.
8. Payment and Billing
Paid plans are billed monthly. Continued use after a free trial constitutes agreement to pay applicable fees. Accounts with unpaid balances may be suspended. Refunds are not provided for partial months.
9. Intellectual Property
The Service and all content, code, and functionality are owned by OpsPilot LLC. You may not copy, modify, or distribute any part of the Service without written permission.
10. Limitation of Liability
The Service is provided "as is" without warranties. OpsPilot LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
11. Termination
Either party may terminate the account at any time. OpsPilot LLC may suspend or terminate accounts that violate these Terms or remain unpaid.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law provisions.
